to speak against this legislation. supervisors wiener and farrell, i guess supervisor farrell isn't here but you spoke forcefully in support of rent control earlier in the afternoon and yet your actions contradict your words because you're attempting to chip away at rent control right now. our largest source of affordable housing in it san francisco. supervisor kim, you had great questions earlier, questions about the ability of this legislation to withstand palmer lawsuits. regarding parkmerced, if people, who -- if the people who crafted the deal to make the garden apartments rent controlled in perpetuity or at least for the duration of the current tenant had not been so worried about the illegal weaknesses of the parkmerced deal there would have been no need to create the 200 million backup fund to protect tenants in case of court challenges and i imagine that 200 fund itself is probably on legal shaky ground. that could be challenged. so if the parkmerced development is on shaky legal ground i can only imagine this legislation is on equally shaky legal ground. there needs to be affor

. >> supervisor farrell: to supervisor kim's question, when you go through the lottery, let's say you win the lottery or convert otherwise, there is a fee to start the process going forward. that fee will not be waived. that will continue in time. this is a new and separate fee. the dollar amount out of that nee came from the nexus study conducted, studying the effects of a condo converse study two years ago. happy to provide you with that. but that's where that fee emanated from. >> co-chair kim: in terms of depending on the number of years obviously that fee reduces down to $4,000. i know there's concern about whether $4,000 per unit can mitigate the loss of rent control units. beyond the normal existing procedure that we have currently for -- to ensure that there's sort of a metered rate at which we lose -- basically lose rent controlled units. >> supervisor farrell: i challenge probably the premise of that comment but i will say that the amount of fee reduction was a balancing act -- and to the city attorney can speak to further detail about that. we have to match that with the nexus
provisions for lifetime leases in this than there have been in parkmerced. mr. farrell, this does open the door to speculation. yes, there is speculation but that is why it's called speculation. and i will do everything in my power to defeat, in the next election, supervisors who vote for this law. >> chair wiener: thank you. next speaker. >> i'm here -- my name is david wallace and i'm a t.i.c. owner and i'm here to ask you to support this legislation. this legislation will have a huge impact on my future, and ability to afford my home. originally, my t.i.c. held a group loan to reform -- financial. thorn bird collapsed in 2008 and my loan was sold. it was well known that before thornberg collapsed, they allowed transfer of our group loans in the interest of thornberg and t.i.c.'s qualified buyers. after the collapse my loan was sold and no longer transferable. one of our owners was transferred out of the san francisco to san diego. she tried to sell, and at this point we all realized that we had to refinance, with a great burden to us, caused a lot of stress in our t.i.c. i was looki

name is -- scott wiener and mike farrell do not represent homeowners. that's a smokescreen. they represent big developers. they promise a lifetime lease but the city attorney has admitted there are no funds allocated to enforce the lifetime lease. obviously they have no intentions to enforce it. scott wiener and mark farrell are not representing homeowners but looking to sell our city to the highest bidder. people often don't realize that civil liberties such as freedom of self-expression are connected to people's rights of housing. look at the bush administration. he was in the business of selling america to the highest bidder. we are experiencing similar in san francisco. is it any wonders who the san francisco who -- the nudity ban, the same supervise is now destroying rent control and selling san francisco. scott wiener, mark farrell are betraying the people of san francisco. they're slick republicans dressed up as democrats. we're witnessing a corporate takeover of san francisco politics. body freedom is our birth right and no one has the right to take it away, so is e
farrell and others, i think even if we were to allow the current generation of t.i.c. owners to allow them to condoize, the concern is that we would quickly replace them with a new generation of t.i.c. owners, and potentially additional real estate speculation that could lead us right back to an identical debate within a short period of time and that's fundamentally an issue that i have with this particular proposal. and i would love an initial i guess comment on that, and certainly if there are suggestions from the public on this but to me that seems to be a fundmental piece that i wish was addressed by the legislation. >> chair wiener: president chiu, that is inherently speculation, nobody knows. to believe one side or another to me is something that we should not be doing. two things that i would articulate. first of all owner occupancy rules dictate there needs to be owner occupancy for a number of years before this is to be eligible for the condo lottery. in most instances it's three years for a certain amount of tenants for larger buildings it gets more complicated. the even potentia
